Abstract

The paper analyzes economic parasitism as a behavior addressed by law to protect industrial property rights. It defines parasitism as the act of placing oneself in another’s wake to appropriate the results of their financial, intellectual, or promotional efforts. By focusing on links with trademark law and, more broadly, industrial property, the article explains how actions based on parasitism can complement traditional IP remedies to prevent usurpation of goodwill and to preserve fair competition.
