Abstract

The paper examines the mechanism of precautionary registration that is grounded on the filing of a judicial claim. It explains the legal rationale for linking registry protection to pending litigation, details the procedural requirements and conditions for obtaining the entry, and analyzes its effects on priority and the protection of the claimant’s alleged rights. The author also discusses the limits of the measure, including how it may be lifted or transformed into a definitive registration once the dispute is resolved.
